Privacy Policy
Last updated October 2, 2026
This Privacy Policy explains how Eternal Photo Dept, a sole proprietorship based in Santa Clara County, California (“Eternal Photo Dept,” “we,” “us,” or “our”), collects, uses, and shares information when you visit eternalphotodept.com (the “Site”) or contact us through it. By using the Site, you agree to the practices described in this policy, which should be read together with our Terms & Conditions.
1. Information We Collect
Information you provide. When you submit an inquiry, we collect the information you enter: your name, email address, phone number (optional), the service you are interested in, your desired date, the location, and your message. This may include details you choose to share about other people, such as a partner or family member.
Information collected automatically. When you visit the Site, our website host, Framer, automatically receives standard technical information, such as your IP address, browser and device type, the pages you view, the website that referred you, and the date and time of your visit. Framer uses this information to deliver and secure the Site and to provide us with visitor statistics. The Site’s fonts are delivered by Google Fonts, which receives your IP address and browser information when the fonts load.
Cookies and tracking. The Site does not use advertising or tracking cookies, and we do not use advertising or social media tracking pixels.
2. How We Use Information
We use the information we collect to: (a) respond to your inquiry and communicate with you; (b) send you an automatic confirmation of your inquiry; (c) check availability, prepare proposals, and schedule consultations; (d) provide and manage photography services if you book with us; (e) operate, maintain, secure, and improve the Site; (f) prevent spam, fraud, and abuse; and (g) comply with legal obligations and protect our rights. We will not add you to a marketing email list without your permission.
3. How We Share Information
We do not sell your personal information, and we do not share it for targeted or cross-context behavioral advertising. We share information only as described below.
Service providers. We use trusted providers to run the Site and our business, including Framer for website hosting, form processing, and visitor statistics, Google for email and fonts, and an automation service that delivers inquiry confirmation emails. These providers process information on our behalf and only as needed to provide their services to us.
Legal and safety reasons. We may disclose information if required by law, subpoena, or court order, or when we believe in good faith that disclosure is necessary to protect our rights, property, or safety, or the rights, property, or safety of others.
Business transfers. If our business is sold or transferred, information may be transferred as part of that transaction and will remain subject to this policy.
4. How Long We Keep Information
We keep inquiry information for as long as reasonably necessary to respond to you and, if you book with us, to provide our services and maintain business, tax, and legal records. When information is no longer needed, we delete it or keep it only in a form that does not identify you.
5. How We Protect Information
We use reasonable administrative, technical, and physical safeguards to protect personal information, and the Site is served over an encrypted (HTTPS) connection. No method of transmitting or storing information is completely secure, so we cannot guarantee absolute security.
6. Your Choices and Requests
You may ask us to access, correct, or delete the personal information you have given us, or to stop contacting you, by reaching out through the Inquire page. We may need to confirm your identity before acting on a request, and we may keep information when the law requires or allows it, such as records related to a signed agreement. We will not treat you differently for making a request.
7. Do Not Track Signals
Some browsers send “Do Not Track” or Global Privacy Control signals. Because the Site does not track visitors across other websites over time or use personal information for targeted advertising, it does not change its behavior in response to these signals. We do not knowingly allow other parties to collect personal information about your online activities over time and across different websites when you use the Site.
8. Children’s Privacy
The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. Inquiries for sessions involving anyone under 18, such as quinceañera or family portraits, should be submitted by a parent or legal guardian. If you believe a child has sent us personal information, please contact us and we will delete it.
9. Your California Privacy Rights
California residents may ask whether we share personal information with third parties for their own direct marketing purposes. We do not share personal information for those purposes. California residents may also make any of the requests described in Section 6 at any time.
10. Visitors Outside the United States
The Site is operated from the United States and is intended for visitors in the United States. If you visit from another country, your information will be processed in the United States, where privacy laws may differ from those where you live.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated version on this page and change the “Last updated” date above. If we make material changes, we will also post a notice on the Site.
12. Contact Us
If you have questions about this Privacy Policy or would like to make a request, please contact us through the Inquire page on this Site or on Instagram at @eternalphotodept.
